Pdf Summary
The Arcadis 2024 North America Construction Disputes Report examines how technology is reshaping dispute avoidance, mitigation, and resolution in the construction industry. It finds that dispute values remain historically high: the average dispute value in North America rose slightly to $43.0 million in 2023, up 1% from 2022, after a much larger 42% jump the previous year. Average dispute duration also increased modestly to 14.4 months, and remains close to the ten-year average.

The report highlights that the industry is adapting to rapid digital change, including AI, cloud platforms, BIM, drones, robotics, LiDAR, and other digital tools. These technologies improve communication, documentation, data analysis, and transparency, but also create new challenges such as cybersecurity, data governance, and interpreting digital records.

Key findings show that respondents expect more disputes in 2024, and that the building sector had the most disputes in 2023. The most common dispute causes were errors and omissions in contract documents, and failure of parties to understand or comply with contractual obligations. The top dispute-avoidance method was contract and specification review, followed by risk management and constructability reviews. The most important mitigation factors were owner/contractor willingness to compromise, accurate and timely schedules, and early resolution forums such as mediation and dispute review boards.

The report recommends three broad strategies: avoid disputes through collaborative cultures, early symptom detection, and digital trend analysis; mitigate disputes through compromise, accurate schedules, and early resolution processes; and resolve disputes using complete, accurate project records and ADR. Overall, it argues that success in the digital age depends on combining technology with strong communication, clear contracts, and proactive project management.
