Pdf Summary
The ACEC Online Seminar presented referenced links related to recent executive orders and government memos impacting diversity, equity, and inclusion (DEI) policies for engineering firms, dated early 2025. Associate Attorney Cate McCaffrey of Gibson Dunn discussed these developments on February 25, 2025.

Key executive orders from the Trump administration and the current administration include Executive Order 14173, which aims to end illegal discrimination and promote merit-based opportunity; Executive Order 14168, focusing on defending women from "gender ideology extremism" and restoring "biological truth" in federal government policies; and Executive Order 14151, which targets the termination of radical and wasteful government DEI programs and preferences.

Supporting memos from the Department of Justice (DOJ) and Office of Personnel Management (OPM) provide guidance on ending DEI and DEIA offices, programs, and unlawful preferences as of February 2025. Defense Department memos address review and validation of consulting service contracts, aligning acquisition practices with these executive orders.

Various agencies issued class deviations to the Federal Acquisition Regulation (FAR) to implement these new directives. These include memos and acquisition letters from the General Services Administration (GSA), CAAC, Department of Commerce, Department of Homeland Security (DHS), and Department of Treasury, affecting procurement and contracting processes to comply with the rescinded and new EOs.

Additionally, the Millennium Challenge Corporation issued deviations to incorporate multiple executive orders.

These documents collectively signal a significant shift in federal policy away from previous DEI initiatives towards a regulatory framework emphasizing merit-based standards, rescinding prior DEI mandates, and reshaping procurement and contracting guidelines. Engineering firms engaged in federal contracts must review these updated regulations to ensure compliance and understand evolving government expectations related to diversity and inclusion in the workplace.
