President Trump’s March 26, 2026 Executive Order 14398, “Addressing DEI Discrimination by Federal Contractors,” directs agencies to add a new clause prohibiting “racially discriminatory DEI activities” in all federal contracts, subcontracts, and contract‑like instruments by April 25. Penalties for contractor noncompliance can include contract termination, debarment, and potential exposure under the False Claims Act.

 

This order follows a series of DEI‑related executive actions issued in early 2025, reshaping the equal opportunity obligations of federal contractors. The session will clarify how EO 14398 fits into that broader shift and what organizations need to prepare for next.
